Can I File an Auto Injury Claim as an Uber Passenger?

Between Uber and Lyft, there are around 140,000 rideshare transactions per day. With so many people out and about, there are bound to be some accidents and injuries. That raises an important question. If your driver gets in an accident, can you file an auto injury claim as an Uber passenger?

Uber’s Insurance Coverage

The moment you’re inside an Uber driver’s car, the company offers $1M in liability coverage. Uber offers an additional $250,000 in coverage for crashes caused by uninsured drivers. They even offer collision protection up to the value of the driver’s car.

People injured during an Uber ride are within their rights to file a claim. Uber has prepared for this as the business of driving is inherently dangerous. However, there is a small caveat. Because Uber drivers are not employees, Uber insurance policies only go into effect when the damage caused is greater than the driver’s personal insurance.

Filling a Claim

If you are seriously injured as an Uber passenger, you have options. The first thing you should do is call 911 from the scene. If you need immediate medical attention, you should get to the hospital as soon as possible.

Likewise, you should push for a police report. This creates a documented paper trail that will make it easier for your attorney to file a claim. Also, take pictures of the cars, the surrounding scene, and the damage, if you are able.

Documenting Your Injuries

Even if you don’t go to a hospital from the scene, you schedule a visit with a doctor within three days of the crash. If you don’t go to a doctor, you may miss internal injuries.

Likewise, if you don’t seek immediate medical attention after a crash, Uber’s insurance might claim you weren’t seriously injured because you didn’t treat the injury as a priority.
